Maine does not allow associations of unit owners to prohibit or unreasonably restrict the installation or use of EV charging in a unit owner’s parking space or a limited common area parking space.
- Unit owners may be required to submit an application to install charging, and the executive board must approve or deny the application within 60 days of receipt.
- The unit owner must provide a certificate of insurance for the charging station within 14 days of the approval of their application.
- Associations of unit owners can place an EV charging station in a common area for all unit owners to use.
- An association may require a unit owner to remove the charging station prior to the sale of the property.
- In actions to enforce compliance, the prevailing party will be awarded reasonable attorney’s fees.
